Welcome to Gillyware! These Terms of Service ("Terms") govern your access to and use of the Gillyware authentication service ("the Service"), provided by Gillyware, LLC ("we," "us," or "our"). By creating an account, you agree to these Terms.
1. Use of the Service
- Eligibility: You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms.
- Account Creation: You are responsible for providing accurate information during account creation and for maintaining the confidentiality of your credentials.
- License: We grant you a non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
- Prohibited Activities: You may not use the Service for any unlawful purpose or attempt to access, disrupt, or interfere with its systems or security.
2. Connected Applications
Your Gillyware account may be used to access other Gillyware applications via OAuth. Each connected application has its own Terms of Service and Privacy Policy governing its use of your data. We are not responsible for the practices of connected applications.
3. User Content
Profile data you provide (name, email, phone number, profile picture) remains yours. You grant us a worldwide, non-exclusive, royalty-free license to store and process it to provide, maintain, and enhance the Service.
3a. Account Security Features
We may offer optional security features such as two-factor authentication. By enabling these features, you consent to the collection and use of the information necessary to provide them (e.g., phone number for SMS verification). You are responsible for maintaining the security of any recovery codes or enrolled devices.
4. Privacy and Your Rights
Our collection and use of your data is governed by our Privacy Policy, incorporated into these Terms.
5. Data Retention and Deletion
When you request account deletion, your account is deactivated and your data is scheduled for permanent removal within 90 days. Deleting your Gillyware account also schedules deletion of your data in all connected Gillyware applications. You may cancel the deletion within the 90-day window by contacting us. After this period, deletion is permanent. You are responsible for any backups you need before requesting deletion. We are not liable for data loss after the retention period has elapsed.
6. Modifications to the Service
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any resulting changes or interruptions.
7. Termination
- By You: You may stop using the Service and delete your account at any time via your account settings.
- By Us: We may suspend or terminate your access if you violate these Terms or for any reason at our discretion.
8. Limitation of Liability
To the maximum extent permitted by law, Gillyware, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. The Gillyware authentication service is provided free of charge; accordingly, our total liability for any claims arising from your use of this Service is limited to the fullest extent permitted by applicable law.
9. Indemnification
You agree to indemnify and hold Gillyware, LLC harmless from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts of Florida.
11. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated through the Service. Continued use after updates constitutes acceptance.
